Stark & Stark is pleased to welcome Shareholder Joseph McCarthy, Esq. to our Hamilton office. Joseph is a member of the Banking & Financial Services, Bankruptcy & Creditors’ Rights, Commercial Litigation, and Real Estate Tax Appeals Groups, where he represents large financial institutions, hedge funds, landlords, small businesses, and other creditors in a variety of litigation and transactional matters including commercial and residential mortgage foreclosure actions, collection actions, bankruptcy, receiverships, general litigation matters, appellate advocacy, commercial real estate purchases and sales, leasing transactions, and commercial lending.

Shareholder Bhaveen R. Jani, Esq. Reappointed as New Jersey’s Revitalization Governor for the American Association for Justice

Stark & Stark is proud to announce that Shareholder Bhaveen R. Jani has been reappointed to serve as New Jersey’s Revitalization Governor for the American Association for Justice for another two-year term beginning in February. The Revitalization Governor is a member of the Board of Governors of the American Association for Justice, which is the governing body of the Association and helps to further the Association’s mission to promote justice and fairness for injured persons and safeguard victims’ rights. The American Association for Justice has successfully defended Americans’ right to trial by jury for over 70 years and continues fighting today to protect practices, clients’ rights, and the civil justice system.

Bhaveen has been involved with the American Association for Justice for several years and current serves as the Minority Caucus Fundraising Chair, and as a member of the Membership Outreach Committee.

Snow, Snow, Snow = Slip and Falls

slip and fall on snow injuryNow that parts of NJ and PA have seen their first snowfall of the year, it is important to remember that all of this snow makes for dangerous walking conditions. As the amount of snow accumulation continues to increase, so does the chance of being hurt as a result of slipping on ice or snow.

What to do is you slip and fall from snow on someone else’s property?

There are a few things that you should do if you are hurt on someone’s property as a result of snow or ice.

Seek Medical Attention

The first thing is to be sure that you seek medical attention. If you are seriously hurt, you should call 911 and wait for an ambulance.

Notify Property Owner

Next, you should notify the property owner so that they may correct the dangerous condition. You do not want anyone else to be hurt as you were. Also, this will help prove that you were really hurt on their property. If you are hurt on a commercial property, they may want you to complete a report or give them a statement. Be careful when doing this. They will usually try to use whatever you tell them against you later.

Take Pictures!

Pictures. Pictures. Pictures. If possible, you should take pictures of the dangerous condition. If you have a digital camera or cell phone with a camera built in, take several pictures of the area where you were hurt. Pictures can be very valuable in proving that the dangerous condition existed. Also, it will prove that the property owner should have taken care of the condition before you were hurt. These pictures could help you win your case.

Stark & Stark Shareholder Secures $2.5 Million Settlement for a Grandfather Who Suffered Life-Changing Injuries in a Car Crash

Before November 26, 2019, our 66-year-old client could not sit still.

Whether it was beating his 35-year-old son in sprinting races, playing cricket, climbing mountains, working in the field for the U.S. government, working as a handyperson or playing with his three grandchildren, our client was always on the move.

But in the early evening of November 26, 2019, our client’s life changed forever.

The car he was driving was struck by another car making an illegal left turn. The injuries our client suffered required him to undergo three serious back surgeries and extensive pain management treatment.

Today, our client struggles to get out of bed, cannot do any of the recreational activities he once loved, no longer works for the federal government or as a handyperson, earns a fraction of the income he used to, and can no longer hold his grandchildren in his arms.

Bhaveen Jani, Stark & Stark

Recently, a little over four years after our client suffered life-changing injuries in that crash, Stark & Stark shareholder Bhaveen Jani and his team obtained justice for him and his family by securing a $2,500,000 settlement in a lawsuit he filed regarding the crash as the case was set to go to trial.

The case, however, was no slam dunk. A year before the crash, our client had three lumbar epidural injections and consulted a surgeon regarding his back pain. To combat the defense’s possible legal arguments regarding our client’s prior back issues, Bhaveen and his team engaged an epidemiologist with a forensic medicine background to establish a substantially higher probability that our client’s injuries and surgeries stemmed from the crash rather than any pre-existing issues.

“This was a complicated case from both an economic and non-economic damages standpoint,” said Jani. “We hired the best medical and economic experts in the field to unquestionably prove that our client suffered significant and new injuries, given his prior medical history. The defense recognized that our client was genuine and likable, which forced them to settle on the eve of trial because of how likely it would have been for a jury to find in his favor and award him significant damages.”

In addition to the epidemiologist, Bhaveen and his team obtained a life care plan for our client, hired a neurosurgeon to provide an independent medical examination, retained a forensic economist and vocational rehabilitation counselor to calculate our client’s future economic loss, and worked with outside companies to assemble a mediation video, a “Day in the Life” video, and medical illustrations of our client’s surgeries.

“I love what I do because of  clients like this one,” said Jani. “I cannot turn back the hands of time, but I can make sure our clients get the compensation they deserve for lifelong injuries caused by others’ wrongdoing.
